Dear Maurice Kirk

I have read your latest posting entitled Lord Leveson to hear Maurice’s Application at The Criminal Court of Appeal sitting at Cardiff Crown Court on 14th March 13 on

http://kirkflyingvet.com/blogs/legal/archive/2013/03/10/lord-leveson-to-hear-maurice-s-application-at-the-criminal-court-of-appeal-sitting-at-cardiff-crown-court.aspx

and have just posted this as a comment:

In light of this article printed by the Western Mail Group and particularly Martin Shipton who is personally aware, and, slippery shouldered your infamous case as a matter of public interest and accountability despite their offices being a mere 50 yards from Cardiff Justice Centre
http://www.walesonline.co.uk/news/wales-news/2013/03/10/no-welsh-police-corruption-prosecutions-despite-scores-of-complaints-91466-32955394/
perhaps Rhodri Glyn Thomas Plaid Cymru’s spokesperson on policing should make effort to walk from his ivory tower in the bay and attend the biggest policing corruption case Wales has ever endured.
In the above article Rhodri Glyn Thomas is quoted as saying.

“It is very important that the police are not placed above the law and immune from the consequences of any wrongdoing. “Their conduct should be of the highest standard and, if it is not and deemed to be criminal, they should face the judicial process. “Standards within police forces need to be very high if public confidence is to be maintained. The four Welsh police forces need to bear this in mind very carefully when allegations of police corruption are upheld in internal inquiries.”

The fact that no reporter can walk the 50 yards to report on this, the biggest police corruption case in Welsh history beggars belief.

Furthermore, the fact that an elected representative of the public at the Welsh Assembly can speak about police corruption and not physically see it on his own doorsteps at Dyfed Powys and Cardiff Justice Centre is very worrying indeed. Wilful Blindness springs to mind.

You will recall when you attended the “Llangunnor Six” meeting at Dyfed Powys Police Headquarters in Carmarthen, Alan Fry South Wales Police Chief Executive stood in for Keith Reeves Chief Executive of Dyfed Powys Police due to his illness.

It is now of no surprise why Alan Fry deliberately blocked the seriousness of the “Llangunnor Six” meeting.

It can be further argued that it is Alan Fry that deliberately quashed the seriousness of the issues brought to his attention by the “Llangunnor Six” in order to protect the integrity of his own Chief Constable Barbara Wilding. Therefore, the only fall guy from that meeting was Dyfed Powys’ Chief Constable Terry Grange.

Furthermore, the question now is; is it South Wales Police that is orchestrating all the further abuse that the “Llangunnor Six” endures at the hands of the notorious Dyfed Powys Police?

And, what part has Adrian Oliver of Dolmans got to play in his capacity as solicitor/s for both Dyfed Powys and South Wales Police Forces within this abuse and persecution.

Yours sincerely,

But: his house was squatted, the squatters had used his antique furniture as firewood and his attempt to complain to the ‘gendarmerie’ resulted in him being arrested – with the intention to lock him up in a mental hospital.

First he made this call, then his account appeared on his website, witnessed by a friend…

Having observed maybe some 100 case of white collar crimes by now, my conclusion is:

‘the system’ of official institutions is ALWAYS by far worse than whatever any individual may have done wrongly

the individual experiences an accumulation of ‘shock treatments’, while ‘the system’ includes oodles of people from many organisations and departments who don’t accept any responsibility for their irresponsible behaviour

organisations always outlive individuals who die away, proud to have fought, but without any justice or compensation.

Furthermore,

the system always covers up instead of admitting to any mistake

the system never says “I’m sorry”

the system always errs on the punitive side.

I just wonder how much worse things have to get! At the hearing of Norman Scarth – in his absence – the issue is the necessity to Abolish the Ban on Recording Court Proceedings. Reading the comments by signers of the petition, is like reading Maurice’s experiences, too…

I would have thought that

officials must realise that they can’t hide behind the veil of secrecy forever

the appearance of ‘prim and proper’ is out of the window, ever since Hillsborough, Savile and paedophilia became topical

the pretence of ‘fair and just’ is a complete farce, given our experiences.

The only way out seems to be an amnesty / jubilee, with the Government as Compensator of Last Resort.

For the only ‘justice’ is the conscience of the perpetrators who also will have to relive what they did when they die… There is a great account of a near death experience by Anita Moorjani who wrote the book Dying to be Me as a result.

Maurice was imprisoned once again, clearly to prevent him from handling and winning his ‘machine gun case’ adequately. But to kick him out after a robbery and beating, is a bit much for a 67-year-old man whose life has been ruined by South Wales Police.

At the same time, Tony Farrell, former Principal Intelligence Analyst of South Yorkshire Police hands himself in, as he writes here:

The Principled Analyst Not Against the Police Service

At 5pm on Sunday 30th September 2012, I pressed the button of a door outside Digbeth Police Station in Birmingham as the building was closed to the public. Over the phone system, I spoke to an operative and told them I was presenting myself for arrest under Section 15 iii of the Terrorism Act 2000. The operative took some details and told me to wait for assistance. Within 5 minutes, three police cars pulled up outside and five uniformed police got out of their vehicles.

I stood still and held out my arms with wrists together so that they could easily cuff me. They asked me what did I want them to do that for. I said I wanted the police to do their duty and act in accordance with the law. I quoted the act at them. None of them seemed aware of the S15 iii TA2000. I told them that I was confessing to the above offence and wanted to clear my conscience. I told them I had in the past paid lots of money to an organisation which I had reasonable cause to suspect had been engaged in terrorist activity and that now that I was aware that what I had done in the past was a criminal offence. I told them I just wanted to make a fresh start and confess my crime and take the full consequences of the law.

They asked me how much money was involved, I said about £1500. They then asked my who was the terrorist person I paid money to. I replied that it was not really a person but rather a large organisation that they had had lots of underhand dealings with. ( I was referring here to West Midlands Police’s role in the cover up of Hillsborough). So they asked me the name of the organisation. I said South Yorkshire Police. I said I had paid them money via Barnsley Metropolitan Borough Council.

They all looked bewildered. They asked me how I came to suspect South Yorkshire Police were engaged in terrorist activity. I told them who I was and that I had been the Principal Intelligence Analyst in SYP for a long time and had come to disbelieve the Government narrative on 7/7 in July 2010. I mentioned the roles of former Chief Constable Meredydd Hughes and DCI Steve Williams in the London Bombings and the role of other officers in sacking me for speaking truth to power.

One of the five officers who was an Asian held out his hand and said I’d like to shake your hand Mr Farrell. Two other officers did likewise and then left me with two remaining officers who took me to the police station for further questioning. They declined to arrest me however.

At the station I was searched and they took details. Everything was amicable and I was well looked after. The uniformed officers seemed to be waiting for a steer from West Midlands Counter Terrorism Unit. They tried also to contact South Yorkshire Police to confirm my identity but seemingly could not get through to anyone there. I told that over and above who I was, I told them tat I had recently acquired information that could be very useful for the police service and would share it only if I thought I could trust them to act in accordance with their oath and duties. They said that would best be done in conjunction with West Mids CTU.

After an hour or so of waiting for contact with South Yorkshire Police, I suggested that the officers look on the internet instead to confirm who I was. So they took me to a computer and googled a few things. One of them remarked as he was reading my letter addressed to all Chief Constables, bloody hell you are quite famous.

They looked at Nick Kollerstrom’s website. Briefly they looked at the Kollerstrom and Farrell are Dead film and others and said they would watch them in their own time. All this appeared entirely new to them. They did not seem aware of any of this activity by truth activists.

After three hours of frank but pleasant exchanges, they drove me home and came inside my appartment. They admired my chess set and I gave them colour copies of my analytical reports of 7/7, 9/11 and the terror threat which are now in the Royal Courts of Justice. I asked them to read, digest and pass on to West Midlands Counter Terrorism Unit. They thanked me for them.

They shook my hands, wished me well and left. That evening I left Birmingham and headed for Sheffield to confront South Yorkshire Police. But that’s another story. Updates to follow!

The moral of this little story is that Police Officers and the Police Service need our help in exposing what is going on.

Criminal lawyer Stuart Hutton believes a database should be created to monitor officers’ track records.

Mr Hutton said the rules need to be tightened up and suggested a possible merging of the Inspectorate of Constabulary and Police Complaints Commission.

“A regulatory authority would provide a cast iron decision,” he added.

“We need regulations so we know exactly what the rules are, serving police officers know what the rules are, and it transcends the internal views that different police forces have in terms of interpreting their obligations to the community.

South Wales Police said the force had “a dedicated professional standards department who ensure we are progressive and robust in responding to allegations, conducting complex investigations into officers whose behaviour or lifestyle presents a cause for concern”.

North Wales Police said every case “would have been considered carefully” and there were “few occasions” where accepting resignations was appropriate.

The Gwent force said any reports of improper conduct by officers or staff would be fully investigated by the professional standards department or, where appropriate, be referred to the Independent Police Complaints Commission.

Dyfed-Powys Police’s website says officers should behave “appropriately at all times”, and must “act in a manner that does not discredit or undermine public confidence in the police service”.

A Home Office spokesperson said: “The Home Office and police service have strengthened the mechanisms around dealing with police misconduct and vetting of police officers.

“Responsibility for day-to-day policy, operational decisions and individual cases lies with police forces.”

But Dr Tim Brain, an honorary senior research fellow at Cardiff University and a former chief constable of Gloucestershire, said that while a resignation would mean the whole process including a disciplinary hearing would not be able to be completed, an investigation could be, and a police force could issue an apology.

A criminal lawyer says there needs to be a stronger system of tracking police officers who resign during misconduct investigations.

In some cases, officers who resign from one force can get a job in a different force before investigations conclude.

In police forces in Wales between 2009 and 2011, 25 officers resigned while under investigation.

Campaigning lawyer Stuart Hutton believes a database should be created to monitor officers’ track records.

The Home Office said procedures had been strengthened, but responsibility lay with individual forces.

There is concern that some of the officers who resign during an investigation will go on to work for a different force without the investigation being completed.

“If there is an investigation, I think the police force should transparently parade in a proper manner the people that they are investigating and the outcome of that investigation”.

Stuart Hutton Criminal lawyer

Some experts believe the loophole has a negative effect on forces’ integrity.

Figures show that between 2009 and 2011, 18 South Wales Police officers resigned during investigation.

North Wales Police had four officers resign while under investigation, and there were three in Gwent.

While no Dyfed-Powys Police officers resigned during an investigation, two were dismissed and eight received a written warning.

Mr Hutton, a campaigner on miscarriages of justice and human rights issues, said: “Justice hasn’t been seen to be done in the sense that the officers have left.

“The matter then becomes buried and perhaps is in danger of becoming lost and the consequences of that is obvious.

“No record is kept, which is not helpful for successive employers or successive police forces who may employ that person who’s being investigated.”

Criminal matters

He added: “If there is an investigation, I think the police force should transparently parade in a proper manner the people that they are investigating and the outcome of that investigation.

“If a complaint has not been upheld because somebody has left the police force before that opportunity has arisen, then the police should have an intelligent database which may not be public.”

However, for me as a relative newcomer to white collar crimes, it is rather shocking to see these two books about South Wales Police and the CPS:

Some samples for what Maurice has to endure courtesy of South Wales Police added to the shock therapy of today:

a Complaint Form

I have been in custody for 7 days and denied stamps / phone calls more ??? total of £3 / writing materials envelopes / access to library / law books etc. etc.

A dozen or so applications last week only got me 10 private legal tel numbers and one for a lawyer not part of my several ongoing court cases.

I have £300 approx. in private funds. I am unconvicted and need immediate access to phone credit as 40p remains.

Still refused photocopying, recorded delivery posting, legal papers in my cell, go on education wing (dustbin full of discarded paper, pens, paper clips from tags and other vital stuff for court process).

a Report that he had been ‘fighting’ with two young men who had stolen his tobacco

No spare tobacco now to bribe those in long phone queues with my average screws now on one phone call a day!

Have gone 5 days at a time no phone or out of order.

My complaint re time delay on each prisoner not hogging it has been, at least, introduced by Justice Ministry.

Maurice now suffers from a shoulder injury and I wonder:

what is going to give when?

when are Courts, Police and Prisons going to remember that they are part of the human race?

who is going to begin to think “enough is enough”???

No, you can’t make it up, and you can’t believe it either, for you can’t imagine it (unless it happens to you!):

Maurice is subjected to over 7 months prison and psychiatric clinic because of ‘serious brain damage’ and ‘possibly brain cancer’ of a report by the Director of Caswell Clinic

he gets a scan done in France that proves that there is “nothing between his ears”

he gets a scan done by the NHS that proves “nothing wrong with his brain”

he gets imprisoned by South Wales Police for having published this article on his website – which MAY be a breach of his ‘restraining order’ that is meant to protect that Caswell Clinic Director.

The Rule of Law has been replaced by lawlessness ensured by South Wales Police, I get the impression. Or rather: one law for ‘them’ and another one for ‘us’. The question is: who defines ‘them’ and ‘us’???

Here’s the petition to support Maurice, if you feel like clicking.

This is BBC News: A report by the police watchdog shows Dyfed-Powys Police topped a list with corruption allegations made against it for the size of its force. But the IPCC Chair Dame Anne Owers says: “Corruption is not widespread.”

Well, how do you measure corruption? The IPCC report only comes up with the number of complaints per 1,000 officers. But would there have been a demo, if there hadn’t been a problem???

Maybe a better measure is the number of visits to websites!?

Victims Unite

over 108,000 since August 2010

This site

over 9,500 since August 201

Or the instant response by Keith Vaz MP to the Abolish the IPCC demo?

Or the number of signatures and page views of online petitions and the remarkable quality of their comments?

Or is it the 200 parents whose children are taken against their will and who are sent to prison on top of losing their kids? I don’t think this can happen without police, can it?

I better write to Dame Anne Owers and open her eyes in the ivory tower behind her desk!

Michael Doherty who tried to get the Police to investigate his 13-year old daughter becoming the victim of internet stalking, became victimised himself by Hillingdon Police. He is now organising a demo outside the IPCC with a great list of speakers: 90 High Holborn, 3-6pm

Leicestershire Police have failed the Portuguese police in the McCann case, as documented by this story of the Portuguese top investigator

Maurice has been challenging not only South Wales Police but also the IPCC and is currently having an issue with them; look at what they manage to organise in HMP Cardiff: the duty doctor under a fake name!

Haringey Police are clearly the main driver in the Musa case and even showed up at their home in Croydon in their prelude to arresting them eventually; their ways of fudging their bail records are beyond belief.

Will HMG follow the model of the Australian Royal Commission into New South Wales Police which, in 1996, found paedophilia at the heart of corruption?

Well, so far, 151 MPs are asking for the case to be dropped and for MPs to have the right to freedom of expression in this Early Day Motion.

At the same time, Caul Grant is starting on his second week of demonstrating outside the Royal Courts of Justice accusing the Judiciary Guilty of Criminal Acts. And so far, 13 MPs question the Ethics of Law Firms!

The videos include John Hemming MP who pointed out that Parliament can remove judges!

Peter Hain MP’s barrister said:

The fair criticism of judges and judicial decisions is not only quite clearly a right, there are also occasions when there may be a duty to do it.

At long last, after in 2009 it was written that he had ‘serious brain damage, possibly brain tumour’. But she is unknown to six medical staff in prison… Might she be one of those ‘unqualified’ experts who are used to snatch children?

Meanwhile, Prisoner Kirk has no more phone credit to telephone out.

Do you feel like picking up the phone for him?

Would you like to find out what HM Governor Richard Booty has to say about Prisoner Kirk [A 7306 AT]? HMP Cardiff is on 02920 923100.
